电击法非法狩猎问题研究

Study on the Issue of Illegal Hunting by Electric Shock

非法猎捕野生动物违法犯罪活动日益增多,而电击法非法猎捕野生动物由于犯罪成本低,猎捕效率高等原因,相对于其他猎捕方式在野生动物猎捕方面有着独特的优势,在各地被广泛使用。目前我国在电击法猎捕野生动物方面相关研究极为欠缺,从而导致在办理相关案件时,在适用法律、案件打击和预防等方面都存在很多困扰。本研究基于实地调研的50个地区县级以上森林公安机关办理的电击法非法狩猎案件,着重从电击法猎捕野生动物案件的现状及特点、公安机关对于电击案件涉案物证的鉴定、打击和防范此类案件时存在的问题等方面进行研究,在此基础上,从管理层面、法律层面和思想意识层面进行对策研究,提出了防范和打击该类案件的对策,为公安机关防范和打击电击法非法狩猎提供一定的参考。

Illegal hunting of wildlife has gradually increased,and electric shock hunting of wildlife has unique advantages over other hunting methods because of its low crime cost and high hunting efficiency.To date,there have been few studies of wildlife hunting by electric shock in China,which complicates enforcement of laws,solving cases,and prevention of related crimes.We reviewed cases of electric shock handled by forest police in 50 regions of China to analyze the current situation and characteristics of criminal cases,to assess material evidence involved in electric shock cases,and to identify obstacles to solving and preventing such cases in future.Based on this review,we offer recommendations applicable to management of enforcement,development of laws and regulations,and public education.Our goal was to provide guidance for enforcement officials in preventing and combating illegal hunting cases by electric shock in the future.
