论专利审查中网络证据的有效性

On the Validity of Network Evidence in Patent Examination

伴随着计算机网络技术的迅猛发展,网络逐步成为公众获取信息的重要渠道之一,在实质审查、无效宣告乃至专利法领域中网络证据经常被使用,而在使用网络证据的过程中,网络证据的有效性是经常遇到的难点之一。关于网络证据有效性的认定,应重点关注其公开性、真实性以及公开时间的确定,本文结合具体的案例探讨了发明专利实审中如何判断网络证据的有效性并给出一些建议。

With the rapid development of computer network technology,the network has gradually become one of the important channels for the public to obtain information.In the field of trial,invalidation and even patent law,network evidence is often used.In the process of using network evidence,the validity of network evidence is one of the difficulties which we will often encounter.Regarding the identification of the validity of network evidence,we should focus on the determination of its openness,authenticity and open time.This paper discusses how to judge the validity of network evidence in the actual trial of invention patents and gives recommendations for review.
