摘要
茶叶是中国的特产,在很多地方是重要的产业。同时我国拥有众多的知名茶叶品牌,茶叶品牌自身拥有地域性、品牌垄断性、高附加值性的特征,其保护和建设不断推进。地理标志作为商标法的法律制度,能够与茶叶品牌的保护和建设紧密契合,发挥其独特作用,但面临权属不清、管理不周、品牌意识不足等问题。
Tea is a specialty of China and an important industry in many places.At the same time,China has many well-known tea brands,tea brands own regional,brand monopoly,high value-added characteristics,its protection and construction continues to advance.As the legal system of trademark law,geographical indication can closely fit with the protection and construction of tea brand and play its unique role,but it is faced with the problems of unclear ownership,poor management and insufficient brand awareness.
