全面保障档案信息化工作,助推社会数字转型——新修订《档案法》信息化条款述评

Comprehensively Guarantee the Informatization of Archives and Promote the Digital Transformation of Society—Comments on the Informatization Clauses of the Newly Revised Archives Law

在新修订的《档案法》中,“档案信息化建设”专章入法是我国档案信息化建设历程中的重要里程碑,为数字转型时期的档案信息化建设提供全面的法律保障。文章从各国通用做法、信息技术带来的新挑战、信息化长期发展积累的经验成果、法律效力的明确与业务的宏观指引等四个方面分析了档案信息化入法的必要性和可能性,并从新修订的《档案法》对电子档案法律效力的明确回应、注重档案信息化建设的支持保障与关系协调、全覆盖信息化核心要素三个方面进行阐述。

The entry of the special chapter"Ar⁃chives Informatization Construction"in the newly re⁃vised Archives Law is an important milestone in the course of archives informatization construction in Chi⁃na,which provides a comprehensive legal guarantee for the construction of archives informatization in the digital transformation period.This article analyzes the necessity and possibility of informatization of ar⁃chives into law from four aspects:common practices in various countries,new challenges brought by infor⁃mation technology,accumulated experience in the long-term development of informatization,clarifica⁃tion of legal effects and macro guidance for busi⁃ness.It also expounds three aspects:a clear re⁃sponse to the informatization of archives,a focus on support and relationship coordination for archives in⁃formatization construction,and the core elements of full coverage informatization.
