《民法典》下运动员的隐私权及个人信息保护

Privacy and Personal Information Protection of Athletes under Civil Code

《民法典》在“人格权编”中对自然人的隐私权和个人信息保护予以了规定,一方面丰富了对自然人人格权益的保护,另一方面亦强调了对个人隐私和个人信息的区别化保护模式。研究认为,运动员主体相较于一般自然人具有行业特性和身份特殊性,由此关于运动员隐私权和个人信息保护应较之一般自然人有不同之认识。在“数字体育”发展背景下,对于我国大多数非职业运动员而言,应从运动员个体和体育管理部门两个维度强化运动员隐私和个人信息的保护,特别保障运动员主体权地位,注意建构类型化的分级保护机制。

The Civil Code stipulates the privacy and personal information protection,which enriches the protection of human rights and emphasizes the differentiated protection mode of privacy and personal information.The research holds that the athletes are of professional characteristics and particular identity,so the athlete's privacy and personal information protection should be different with the general people.With the development of digital sports,for most non-professional athletes in China,the privacy and personal information protection of athletes should be strengthened from two dimensions of individual and sports management department.The protection of the status of athletes'main rights and the construction of typified hierarchical protection mechanism should be paid attention.
