韩国未成年人电子竞技政策法规研究及启示

Researches of Policies and Regulations of E-sports for Minors in Korea and Enlightenment

对韩国和我国的未成年人电子竞技政策法规进行了对比分析。研究认为,韩国的未成年人电子竞技政策法规发展较为成熟,我国虽对互联网大环境、网络游戏和电子竞技设有立法规制,但尚未形成完整的电子竞技法律体系,仅有部分低位阶法规适用于电竞法律实务,缺乏完善的游戏分级和防沉迷制度,在未成年人的防保政策方面存在立法空白。借鉴韩国的电子竞技防保政策法规,我国应加强立法,完善电子竞技政策法规体系;建立健全游戏分级制度;齐抓共管,建立有效的防沉迷制度;强化责任担当,设立监管机构;加强管理,规范电竞俱乐部以保护未成年人健康成长。

The policies and regulations of e-sports for minors in Korea and China are compared and analyzed.The study holds that the development of e-sports policies and regulations for minors in Korea is relatively mature.Although China has legislative rules for Internet environment,online games and e-sports,it has not established a complete legal system of e-sports.Only some low-level laws and regulations are applicable to e-sports,lacking of perfect game classification and anti-addiction system,and there is no specific policy for minor e-sports protection.China can learn from the policies and regulations of e-sports protection in Korea,strengthen legislation,perfect the system of e-sports policies and regulations,establish and perfect the game hierarchical system,establish an effective anti-addiction system,set up regulatory agencies and standardize e-sports clubs to protect minors.
