知识产权法律关系的私法研究范式转换

The Shift of the Private Law Paradigm of the Legal Relationship of the Intellectual Property

由于受到知识产权法学研究主要采用的“诸法合体”综合研究方法的消极影响,知识产权法律关系主要采用了多维度研究方法,这种研究方法背离了知识产权的私权性,致使知识产权法学缺乏科学、统一的学科划分和明确的学科定位。知识产权的私权属性决定了知识产权法学需要确立其应然的私法学研究范式,为此,首先应该实现知识产权法律关系的私法研究范式转换,构建私法研究范式下知识产权法律关系的基本范畴理论。知识产权法律关系的私法研究范式转换,既不能过度强调国家公共政策层面下的激励创新理论,也不能机械套用以有体物为基础的传统民事权利理论。在私法研究范式下,知识产权法律关系应该定性为私有知识财产法律关系,作为知识产权法律关系构成要素的知识产权主体和知识产权客体,则需要回归其应有的技术性的私法范畴。

Due to the negative impact of"combination of all laws"method of the intellectual property law,the legal relationship of the intellectual property mainly adopts the multi-dimensional research method,which deviates from the private right attribute of intellectual property rights,and makes the intellectual property law lack of scientific,unified and clear discipline position.The private right attribute of intellectual property rights determines that the intellectual property law should establish the proper private law paradigm,so it needs the shift of the private law paradigm of the intellectual property legal relationship and constructs the basic theory of the intellectual property legal relationship under the private law paradigm.The shift of the private law paradigm of the legal relationship of the intellectual property should neither overemphasize the incentive innovation theory at the level of national public policy,nor mechanically apply the traditional civil right theory based on tangible objects.Under the private law paradigm,the legal relationship of intellectual property should be defined as the legal relationship of the private intellectual property.As the elements of the legal relationship of the intellectual property,the subject and object of intellectual property need to return to the technical category of the private law.
