Civil law and civil procedure law are both important parts of civil legal system.These two laws are complemental and indispensable of each other.After experiencing the relationship model of the combination of all laws and the separation of these two laws,China has entered into the era of civil code in which the substantive law and the procedural law are merge of each other.Civil law and civil procedure law not only have many same legal ideas,but also many same legal principles.As an encyclopedia of social activities,civil law has the function of adjusting civil legal relationship and provides legal basis for civil trial.The civil procedure law provides a remedy channel for resolving civil legal disputes,resolving social contradictions and guaranteeing civil rights.The homogeneity and commonality of civil law and civil procedure law determine that the formulation of civil code plays an important role in the development of civil procedure law.Civil code contributes to the effective operation of civil procedure law,provides normative guidance for the systematization,greening and applicability of civil procedure law,and promotes the alternation and development of civil procedure law legislation and judicature.
