从不同的路径解释我国《宪法》第九条规定的“自然资源属于国家所有”可以得到不同的答案。要想准确理解我国《宪法》规定之“自然资源属于国家所有”的含义,必须从以下五个关键问题入手:一是正确理解社会主义国家性质下国家与全民的关系;二是合理解释“自然资源属于国家所有”的公权力效力;三是合理解释“自然资源属于国家所有”在社会主义市场经济背景下为何会产生实践矛盾;四是准确把握自然资源的含义;五是明确自然资源国家主权的含义。因此,我国《宪法》第九条规定的“自然资源属于国家所有”实际上是我国社会主义国家所有制的具体体现,意指那些价值重大、决定国民经济命脉、影响国民生计的,作为生产资料的特定(狭义)的自然资源属于国家所有,即自然资源国家所有权。
