我国公司组织类型的变革与重构

伴随我国公司实践的发展,我国公司法关于公司组织类型的规定暴露出诸多不足与缺漏,这不仅不利于我国营商环境的优化,更不利于我国当前经济的发展。适逢《中华人民共和国公司法》(以下简称《公司法》)大幅修改之际,我们应积极回应各种关于公司组织类型变革的建议,寻求适合我国国情的公司组织类型变革路径,重构《公司法》的公司组织类型。对此,我们应充分考虑我国现阶段的市场发展需求,综合考量各种改革成本,积极回应不同投资者的差异化需求,在原有的公司组织类型框架内对公司的组织类型予以变革和重构,进而实现公司组织类型的多元化供给。

With the development of corporate practice in China,the provisions on corporate organization types in China's Company Law have increasingly exposed many shortcomings and omissions,which is not only not conducive to the optimization of China's business environment,but also not conducive to the current economic development.At the time of the substantial revision of the Company Law,in order to reconstruct the organizational types of Company Law in China,we should actively respond to all kinds of suggestions about the reform of the type of company organization and seek the path of reform of the type of company organization which is suitable for the situation of our country.In this regard,we should fully consider the needs of China's market development in the new stage,comprehensively consider various reform costs,and actively respond to the differentiated needs of different investors.Within the framework of the original organizational types of companies,we should reform and reconstruct the organizational types of company,so as to realize the diversified supply of organizational types of company.
