论野生动物保护公益诉讼的建构

全面分析野生动物保护行政执法与刑事司法现状发现行政监管不力、刑法适用范围有限是导致野生动物保护效果不佳的主要原因。提升野生动物保护质效的关键是构建相关机制加强行政监管,扩宽野生动物保护范围。对比研究表明,野生动物保护公益诉讼能够解决上述问题,全方位、立体化地加强野生动物保护。野生动物保护公益诉讼制度的构建应遵循法定原则,通过立法予以确认,在修改《野生动物保护法》等法律规范的基础上出台司法解释,从诉讼类型、适格原告、证明责任、责任形态等方面细化具体程序,确保野生动物保护公益诉讼顺利"落地",有序开展,切实加强野生动物保护,维护公共利益。

Through a comprehensive analysis of the current situation of wildlife protection administrative law enforcement and criminal justice,it is found that poor administrative supervision and limited scope of application of criminal law are the main reasons for the poor effect of wildlife protection.The key to improve the quality and efficiency of wildlife protection is to build a mechanism to strengthen administrative supervision and broaden the scope of wildlife protection.The comparative study shows that public interest litigation of wildlife protection can solve the above problems and strengthen wildlife protection in an all-round and three-dimensional way.The construction of public interest litigation of wildlife protection should follow the legal principle,be confirmed by legislation,issue judicial interpretation on the basis of revising the law of wildlife protection and other legal norms,refine the specific procedures from the aspects of litigation type,qualified plaintiff,burden of proof,responsibility form,etc.,ensure the smooth"landing"of public interest litigation of wildlife protection,carry out in an orderly manner,and practically strengthen protect wildlife and safeguard public interests.
