摘要
我国愈发严重的餐饮浪费现象,不仅造成自然资源、社会资源的浪费,也间接对国家粮食安全保障体系带来严重威胁。通过对实践的考察可以发现,我国餐饮浪费治理面临缺乏明确具体法律规定指引,尚未建立有效立体监管机制等现实困境。通过域外经验的梳理,结合当前实践基本情况,制止餐饮浪费应以法治为根本遵循,推进制止粮食浪费领域整体法律规范建构,建立健全法律实施和执法监督机制,惩戒与激励机制并重,营造节俭就餐社会新风尚。
The increasingly serious phenomenon of catering waste in China has not only caused the waste of natural and social resources,but also indirectly posed a serious threat to the national food security system.Through the investigation of practice,it can be found that the management of food waste in China is faced with practical difficulties such as the lack of specific legal guidance and the establishment of effective three-dimensional regulatory mechanism.Through combing the overseas experience and the basic situation of current practice,we should take the rule of law as the fundamental principle to stop catering waste,promote the construction of overall legal norms in the field of food waste prevention,establish and improve the legal implementation and law enforcement supervision mechanism,pay equal attention to punishment and incentive mechanism,and create a new social fashion of frugal dining.
