大数据背景下个人信息立法保护的多视角研究

An Integrative Study of Legislative Protection of Personal Information Under the Background of Big Data

大数据的广泛应用使得擅自使用或者滥用公民个人信息的状况时有发生,严重侵害公民合法权益。在推动数字经济发展的同时,完善对个人信息的法律保护,进而在数据充分赋能和个人信息保护间实现平衡,是近年来社会各界高度关注的问题。文章从边界定位、技术相适、实践相融等几个方面,对个人信息立法保护进行研究,探索使个人信息立法保护继续推进、在《民法典》基础上更具兼容性和可操作性的路径。

With the wide application of big data,unauthorized use or abuse of citizens personal information occurs from time to time,which seriously infringes citizens legitimate rights and interests.While promoting the development of digital economy,improving the legal protection of personal information,so as to achieve a balance between data empowerment and personal information protection,has been an issue of great concern to every field of society.This paper studies the legislative protection of personal information from the aspects of boundary positioning,technology compatibility and practice integration,and explores ways to push forward the legislative protection of personal information and make it more compatible and operable on the basis of the Civil Code.
