我国流域生态保护补偿本质认定与制度重构

Nature Identification and System Reconstruction of Watershed Ecological Protection Compensation in China

流域生态保护补偿本质是通过补偿流域生态利益提供者,对发展权和环境权进行衡平,实现环境正效应。我国流域生态保护补偿制度尚存在补偿范围不科学、补偿法律关系主体认定不准确、补偿方式单一的问题。未来应通过科学界定补偿范围、准确认定补偿法律关系主体、构建多元化补偿方式对流域生态保护补偿制度进行完善。

The essence of watershed ecological protection compensation is to balance the right of development and the right of environment by compensating the ecological benefit providers of the watershed,so as to realize the positive environmental effect.There are still some problems in the system of watershed ecological protection compensation in China,such as unscientific compensation scope,inaccurate identification of the subject of compensation legal relationship and single compensation mode.In the future,the system of watershed ecological protection compensation should be improved by scientifically defining the scope of compensation,accurately identifying the subjects of compensation legal relations and constructing diversified compensation modes.
