公医诊疗合作与我国复合转诊法制构建——健康治理现代化的训诫

The Cooperation between the Public Health Institutions and the Establishment of the Multiple Referral Legal System in China——Guidance under the health governance modernization

健康领域的现代化治理要求在公共医疗卫生机构之间建立合作关系,然而我国公共医疗卫生服务领域呈现各级各类健康服务机构自由混合竞争的格局,这对公医分类分级诊疗法治秩序构成全面挑战,并成为影响转诊制度构建的重要因素。我国转诊制度的建设应以维护诊疗合作的法律秩序为前提,并有必要将双向转诊制度升级打造为复合转诊制度。为此,需要系统完善复合转诊制度所必需的一系列相关制度,包括医疗机构治理制度、社会医疗保险制度、就诊权益保障制度等。

The modernization of health governance requires the cooperation relationship between the public health institutions.Whereas,the public health care delivery system is dominated by the competitive relationship,which threatening the order of the rule oflaw on the classified medical treatments,as well as the construction of referral system.The public health care system should base itself inherently on cooperative mechanism demonstrated by graded diagnoses and treatment,and the dual referral system should be upgraded to the multiple referral system.For this reason,a serial of system should be improved,such as the systems on the public health institution governance,on health insurance,on the protection of the patients,and so on.
