传统视域下生态补偿被认为是一种责任分配机制,生态综合补偿的提出给生态补偿理论带来了挑战。为了实现生态补偿全过程规制和追求生态补偿整体性效益,生态补偿法制研究应突破传统责任分配和单一权利视域,植入权利与权力的思维。生态综合补偿自主权的理论渊源,根植于生态保护个体与政府之间的信任委托关系,并立足于地方政府生态治理权能,内化为生态综合补偿积极性权力;同时探寻于地方政府可持续发展权,外化为生态综合补偿防御性自由。结合生态综合补偿的运行机理,生态综合补偿内部权力运行的法治保障路径应重塑生态综合补偿自主权的法律价值,打造追求生态综合补偿整体性绩效目标的地方责任政府,坚持法定原则,明晰权力的边界,坚持用权受监督,建立程序控权机制和综合考评制度;生态综合补偿外部权利自由的制度保障主要以基本权利的形态为核心,构建生态综合补偿转移支付制度和落实国家权利保护义务,建立系列性生态资源资本化制度。

In the traditional view,ecological compensation is regarded as a responsibility distribution mechanism.The proposal of ecological comprehensive compensation brings new challenges to the theory of ecological compensation.In order to realize the regulation of the whole process and the pursuit of the overall benefits of ecological compensation,the legal research on ecological compensation should break through the traditional responsibility distribution and single right perspective,and implant the thinking of right and power.The theoretical origin of the ecological comprehensive compensation autonomy is rooted in the trust relationship between the ecological protection individuals and the government,and based on the ecological governance power of local governments,internalizing into the active power of ecological comprehensive compensation.Meanwhile,it is exploring the sustainable development rights of local governments and xternalizing ecological comprehensive compensation for defensive freedom.In line with the operation mechanism of ecological comprehensive compensation,the legal protection path of the internal power operation of the compensation should reshape the legal value,and create a local responsible government that pursues the overall performance of the compensation,adhere to the statutory principle,clarify the boundaries of power,and insist on the supervision of the use of power to establish a procedural law control mechanism and a comprehensive evaluation system.The system guarantee for the external rights freedom of ecological comprehensive compensation takes the form of basic rights as the core to build an ecological comprehensive compensation transfer payment system and implement national rights protection obligations by building serial capitalization system of ecological resources.
