2020年7月27日,最高人民法院首次集中發佈涉產權保護行政訴訟典型案例。產權制度是社會主義市場經濟的基石,保護產權是堅持社會主義基本經濟制度的必然要求。黨的十九大指出,“經濟體制改革必須以完善產權制度和要素市場化配置為重點”,黨的十九屆四中全會指出,要“健全以公平為原則的產權保護制度”,“營造各種所有制主體依法平等使用資源要素、公開公平公正參與競爭、同等受到法律保護的市場環境”。
On July 27,2020,the Supreme People's Court released sound business environment.typical cases of administrative litigation related to property rights protection for the first time.The property rights system is the foundation of the socialist market economy and protecting property rights is the inevitable requirement of adherence to the basic socialist economic system.The 19th National Congress of the CPC put forward that"economic reforms must concentrate on improving the property rights system and ensuring the market-based allocation of factors of production",while the Fourth Plenary Session of the 19th Central Committee of the CPC proposed to"improve the property rights system that based on fairness"and"create a market environment where various ownership entities equally use resource factors according to law,participate in the competition in an open,fair and impartial manner and are equally protected by the law".
