摘要
包含投资专章的《中日韩自贸协定》谈判正在紧锣密鼓进行中。在《中日韩投资协定》的基础上,加快《中日韩自贸协定》的谈判进程,并在完成推动《区域全面经济伙伴关系协定》的签署工作后,最终打造一个“《中日韩投资协定》+《区域全面经济伙伴关系协定》+”的自贸协定,已成为三方的共识。鉴于《中日韩投资协定》中投资者与东道国的投资争议解决机制(ISDS)的可借鉴性,考虑到《区域全面经济伙伴关系协定》谈判已将ISDS排除在外,作为中日韩投资专章重要组成部分的ISDS条款的谈判,宜在《中日韩投资协定》的ISDS机制的基础上充分考虑到在保护投资者利益和确保东道国规制权之间保持平衡的需要以及三国各自对待ISDS机制的态度,同时借鉴ISDS改革背景下新一代ISDS机制的共同特点。
Negotiations on a special chapter of investment under the China-Japan-South Korea Free Trade Agreement (FTA) is still in full swing.Based on the current China-Japan-South Korea investment agreement,the three parties have reached a consensus of accelerating the FTA negotiation process,and expanding the FTA by completing signing of the regional comprehensive economic partnership (RCEP) agreement.With reference to the investor-state dispute settlement (ISDS) mechanism in the China-Japan-South Korea investment agreement,and considering that ISDS has been excluded from the negotiation of the RCEP agreement,the negotiation of ISDS clauses,which will be an important part of the investment chapter of the FTA,should continue to adopt the ISDS mechanism,and fully take into account the need to strike a balance between protecting the investors’ interests and ensuring the regulatory power of the host country,as well as the respective attitudes of the three countries towards the ISDS mechanism,while drawing on the common characteristics of the new generation of ISDS mechanisms in the context of ISDS reform.
