摘要
《中华人民共和国民法典》已经全国人大通过,将于2021年1月起施行。《民法典》处理民事关系,同时民事关系及民事权利与行政立法和行政行为也有着诸多关联性。本文首先分析《民法典》与物权法律及行政法律的关系;然后阐释《民法典》涉及国土空间规划的主要内容,并探究国土空间规划实施中的若干民法问题及解决思路;最后探讨国土空间规划体系与《民法典》相关条款的衔接问题。本文旨在从规划专业角度深化对《民法典》的理解,并希冀有助于推进我国的空间规划制度建设。
The Civil Code of the People’s Republic of China has been adopted at the third session of the 13th National People’s Congress and will come into force in January 2021.The Civil Code deals with civil issues,while civil relations and civil rights are closely related to the administrative legislation and administrative actions.This paper analyzes the relationship between the Civil Code and the property law and administrative law.Then the paper elaborates the main content of the Civil Code concerning spatial planning and discusses some civil dilemmas and solutions in the implementation of spatial plans.Finally,it discusses the connection between the spatial planning system and relevant provisions of the Civil Code.It is aimed to deepen planners’understanding of the Civil Code,as well as to promote the institutional construction of the spatial planning system in China.
