摘要
宅基地使用权的财产功能日益加强,保障功能较之逐渐弱化,宅基地使用权依法流转成为必然趋势。《中华人民共和国民法典》(以下简称《民法典》)规定,宅基地使用权行使、转让和登记的条款,这些原则性规定为宅基地制度改革预留了空间。本文通过梳理《民法典》第362条至第365条的内容,主张应在《民法典》中丰富宅基地使用权的用益物权权能,明确其登记生效主义规则,完善宅基地管理的相关立法规范和流转的相关配套制度,以确保宅基地使用权依法有序流转。
The property function of the homestead is strengthened,and the security function is weaker gradually,which means that the circulation of homestead use right becomes inevitable.The Civil Code of the People's Republic of China(hereinafter referred to as the Civil Code)stipulates the transfer clauses and registration system for the transfer of the right to use the homestead,which reserve space for the reform of the homestead system.By combing the contents of articles 362-365 of the Civil Code,this paper argues that we should enrich the usufruct power of the right to use the homestead in the Civil Code,and define the rules of its registration effectiveness.We should complete the relevant legislative systems and supporting systems of the homestead management,in order to ensure the orderly circulation of the right to use homestead according to law.
