论宪法对弱势群体的保护

On Protection of Vulnerable Groups by Constitution

我国社会现阶段的主要矛盾已经转变为人民日益增长的美好生活需要和不平衡不充分发展之间的矛盾。弱势群体的存在是不平衡发展的表现,加强对弱势群体的宪法保护在当前显得尤为重要。弱势群体的宪法保护主要存在着权利主体规定过于僵化、平等权制度落实不够具体、宪法法律体系不够完善及宪法诉讼渠道不畅通等问题。为更好地对其实现保护,应将弱势群体概念进一步明确,完善宪法法律体系,畅通宪法诉讼渠道,以从根本法的视角加强对弱势群体的保护。

The main contradiction of socialism in our country has been transformed into the contradiction between the growing needs of the people for a better life and the unbalanced and inadequate development,where the vulnerable groups are the case in point for the unbalanced development,and where greater significance should be focused on strengthening the constitutional protection of the vulnerable groups.There are mainly some problems in the constitutional protection of vulnerable groups,such as too rigid subject of rights,the fundamental rights are too general,and there exist a lack of supporting legal system and unsmooth channels of constitutional litigation,etc.In order to better achieve a protection,the concept of vulnerable groups should be further clarified,the system of laws and regulations should be improved,the channels of constitutional litigation should be unblocked,and the protection of vulnerable groups should be strengthened from the perspective of fundamental law.
