村级协商结构的变迁与治理绩效

Changes of Village-level Consultation Structure and Governance Performance

“威权式协商结构”既推动了村级协商的开展,又限制了村级协商的持续发展。以恩施州将律师顾问团纳入村级协商治理的实践为研究对象,发现“专家调和式协商结构”可以显著提升治理绩效。协商结构的变迁,一方面促进了协商行动策略的制度化,从而提升结构的稳定水平;另一方面实现了主体间关系的有序调整,从而提升结构的统合水平。因此,“专家调和式协商结构”较“威权式协商结构”更易提升治理绩效。对比两种协商结构可知,两者的规范设定和资源调节方式不同,权力关系配置的差异是造成此现象的根本原因。构建“专家调和式协商结构”要在尊重村民的主体地位、引入“独立第三方”、重新配置权力关系以及运用法治手段四个方面不断发力。

“Authoritarian negotiation structure”not only promotes the development of village level consultation,but also restricts the sustainable development of village level consultation.Taking Enshi Prefecture's practice of bringing the lawyer advisory group into the village level negotiation governance as the research object,it is found that the“expert mediated negotiation structure”can significantly improve the governance performance.The change of negotiation structure,on the one hand,promotes the institutionalization of negotiation action strategy,thus enhancing the stability level of the structure;on the other hand,it realizes the orderly adjustment of the relationship between the main bodies,so as to enhance the integration level of the structure.Therefore,expert reconciliation negotiation structure is easier to improve governance performance than authoritarian negotiation structure.Compared with the two negotiation structures,we can see that there are differences in the standard setting and resource regulation modes between the two negotiation structures,and the difference in the allocation of power relations is the root cause of this phenomenon.In order to construct the consultation structure of expert reconciliation,we should pay more attention to the villagers'dominant position,introduce the“independent third party”,reconfigure the power relationship and use the means of rule of law.
