摘要
当前我国在认定改编电影作品侵犯保护作品完整权的实践中产生了主观主义和客观主义两种标准,主观主义强调作者对于改编作品的主观感受,客观主义侧重对作者声誉的社会评价。司法实践中评价标准的混乱给我国电影文化产业的健康发展带来了不利影响,也不利于知识产权的保护。确定统一的司法标准,界定保护作品完整权的权利边界已迫在眉睫。
At present,two perspectives of standards,subjectivism and objectivism,are adopted in the practice of judging the infringement of the right of integrity in adapted films.Subjectivism emphasizes the subjective feelings to the adapted works,while objectivism focuses on the social evaluation of the author’s reputation.The confusion of evaluation standards in judicial practice has brought adverse effects on the healthy development of China’s film culture industry,and is not conducive to the protection of intellectual property rights.It is urgent to establish a unified judicial standard and define the right boundary to protect the integrity right of works.
