我国轮胎行业专利保护策略分析

Analysis of Patent Protection Strategies in China’s Tire Industry

介绍近年我国轮胎市场走势、轮胎企业专利申请情况和专利侵权诉讼情况。从专利申请、类型、专利诉讼、市场变化与政策导向方面分析轮胎行业专利现状,并从自主研发、委托开发/合作开发、广告宣传、专利许可/被许可、转让/受让、侵权投诉方面提出专利保护策略。世界龙头轮胎企业的专利以发明专利为主,外观设计专利其次,实用新型专利较少。我国轮胎企业在专利申请量和技术领域分布上均与国外企业有较大差距,应积极响应国家知识产权保护政策,加大创新力度;遇到侵权投诉时或者发现他人侵权时,应积极应对,寻求知识产权专业律师的帮助。

The trend of China’s tire market,patent applications of tire enterprises and patent infringement litigation in recent years were introduced.The patent status of tire industry in terms of patent applications,types,patent litigation,market changes and policy guidance was analyzed.The patent protection strategies from independent research and development,commissioned development/cooperative development,advertisements,patent licensing/licensed,transfer/transferred,and infringement complaints were proposed.The patents of the world leading tire enterprises were mainly invention patents,followed by design patents,and fewer utility model patents.China’s tire enterprises had a large gap with foreign enterprises in terms of patent applications and technical field distribution.Tire enterprises should actively respond to the national intellectual property protection policy and increase innovation.When being encountered infringement complaints or infringed by other companies,tire enterprises should actively respond,such as seeking help from a lawyer specializing in intellectual property.
