区块链技术背景下侦查变革研究

Research on the Revolution of Criminal Investigation under the Background of Blockchain Technology

区块链目前在许多行业已经普及并取得良好效果,“区块链+”的发展趋势越来越明显。法治社会下,区块链为民事诉讼、社会治理、证据规范等方面提供了技术支持,但是“区块链+侦查”尚未突破研究与应用的瓶颈。“区块链+侦查”的研究应当包含哲学及实践价值、理论基础与具体应用三阶层。国外“区块链+侦查”的研究主要集中在犯罪新形势研究、侦查取证和区块链犯罪预防三方面。通过对区块链中外研究的梳理和理论基础、哲学及实践价值的探析,总结出区块链能够从引导侦查理念、强化侦查规范、创新侦查情报工作和规范侦查取证方式四方面促进侦查变革。

Blockchain has been popularized in many industries and achieved good results.The development trend of“Blockchain+”is becoming more and more obvious.In a society ruled by law,blockchain provides technical support for civil litigation,social governance,and evidence standardization,but“Blockchain+Investigation”has not yet broken through the bottleneck of research and application.The research of“Blockchain+Investigation”should include three levels of philosophy and practical value,theoretical basis and specific application.The research on“blockchain+investigation”in foreign countries mainly focuses on the research on the new situation of crime,evidence collection and blockchain crime prevention.Through the combing of Chinese and foreign research on blockchain and the analysis of theoretical basis,philosophy and practical value,it is concluded that blockchain can promote investigation reform from four aspects:guiding investigation concepts,strengthening investigation norms,innovating investigation intelligence work and standardizing investigation evidence collection methods.
