摘要 从劳动法中正当事由出发,梳理了DRC和CAS案例中球员和俱乐部援引正当事由之情形。研究发现:俱乐部以正当事由单方终止合同之情形包括球员运动表现、上场次数、球员受伤等不构成正当事由的情形,以及球员缺席、球员不当行为等构成正当事由的情形;球员从正当事由单方终止合同之情形包括俱乐部未支付或迟付球员薪水,排挤运动员、下放球员或不注册,及其他构成正当事由的情形,除此之外,球员还可援引体育性正当事由单方终止合同。 The paper analyses the DRC and CAS cases in which players and clubs invoke the just cause from the point of view of the labor law.It is found that the circumstances in which the club unilaterally terminates the contract include the performance of the player,the number of appearances,the injury of the player,and the absence of the player and the misconduct of the player.The circumstances in which the player unilaterally terminates the contract include the non-payment or late payment of the player's salary,the exclusion of the player,the devolution of the player or the non-registration,and other circumstances that constitute the just cause,in addition to which the player may invoke the sporting just cause.
