专利行政执法、市场竞争与我国专利创新关系的实证研究——基于中国的时间序列数据

An Empirical Study on the Relationships among Patent Administrative Law Enforcement,Market Competition and China's Patent Innovation--Based on China's Time Series Data

本文运用协整检验、脉冲响应函数和方差分解等计量经济学方法,深入研究了我国在2000—2016年期间专利行政执法、市场竞争和专利创新之间的长短期关系。从长期来看,专利行政执法、市场竞争和专利创新三者之间存在着相互促进作用。从短期来看:①专利行政执法和专利创新短期内存在双向的促进作用;②市场竞争有助于促进专利创新的增加,而专利创新的增加则会对市场竞争有微弱的抑制作用;③专利行政执法与市场竞争在短期内存在着互相抑制的作用。上述结果不仅完善了现有专利行政执法的研究,细化和丰富了知识产权保护的相关理论文献,还为国家更好地制定专利行政执法政策提供理论依据。

In this paper,we used the econometric methods such as cointegration test,impulse response function and variance decomposition to deeply study the long-term and short-term relationships among patent administrative law enforcement,market competition and patent innovation in China during 2000—2016.The study found that in the long run,there was a positive mutual promotion among patent administrative enforcement,market competition and patent innovation.From the short-term perspective:①Patent administrative enforcement and patent innovation played two-way promotion roles in the short term;②Market competition helped to increase patent innovation,while the increase of patent innovation would have a weak restraining effect on market competition;③Patent administrative law enforcement and market competition had mutual restraining effects in the short term.The above results have not only improved the existing researches on patent administrative law enforcement,but also refined and enriched the relevant theoretical literature on intellectual property protection,and provided a theoretical basis for the state to better formulate patent administrative enforcement policies.
