从理论与实践两个维度对我国环境资源法的发展进行研究,环境资源法学科上早已统一,而在实际法律中是分离的,这就需要我们去积极应对。生态文明建设给了环境资源法一个前所未有的发展机遇,但绝不仅仅是供环境资源法谋求独立部门法地位,而是需要环境资源法正视自身:以生态文明思想为统筹,构建生态法治,协调统一环境资源法理论研究与法律实践,对环境法与自然资源法开展法律文件系统化,重视和建构环境法解释理论或者环境法解释方法,增强环境资源法的权威性和可实施性,推动环境资源法的优化整合,为生态文明建设提供强有力的保障。

This paper studies the development of China's environmental and resource law from the two dimensions of theory and practice.The discipline of environmental and resource law has long been unified,but it is separate in the actual law and even scattered in other legal departments.The phenomenon of"two skins"is prominent,which needs us to actively deal with.Ecology civilization construction to the environment resources law an unprecedented development opportunity,but not just for MCUH seek independent department law status,but need to MCUH themselves:in the face to the idea of ecological civilization as a whole,the construction of ecological law,harmonious and unified theory of environmental resources law research and legal practice,for the systematic,environmental law and natural resources law to carry out the legal documents and construction of environmental law explanation theory or environmental law interpretation methods,strengthen the authority of environmental resource law and practical,to promote integration of environmental resource law and provide strong guarantee for construction of ecological civilization.
