摘要
我国的环境司法具有鲜明的地域性特点,不同地区环境司法保护的需求和侧重点各不相同。国家重点生态功能区受生态环境保护影响最大、反应最明显,相关环境政策、法律和制度能否依法、有效实施,也会在司法领域最敏锐、最突出的得以反映。同时,由于特殊的主体功能定位,重点生态功能区的环境司法明显有别于发达地区以环境污染和污染治理为重点的模式。本文以雅安、甘孜为实证样本,在维护环境法治整体性、统一性的前提下,对重点生态功能区环境司法面临的问题,区域环境司法的功能、程序、方法等形成规律性的认识,提出有建设性的意见和建议,为区域环境治理提供有益的司法借鉴。
Different regions of China have different needs and priorities for judicial protection of environment.National key ecological function zones are the most affected by the protection with the most obvious reaction;whether the relevant environmental policies,laws and systems can be effectively implemented in accordance with the law will also be reflected most acutely and prominently in the judicial field.Meanwhile,due to the special functional positioning,the environmental justice in key ecological function zones is different from the model in developed areas that focuses on environmental pollution and pollution control.On the premise of maintaining environmental rule of law as a whole and unity,this paper,with Ya’an and Ganzi as empirical samples,forms a regular understanding of the problems faced by environmental justice in key ecological function zones,the functions,procedures and methods of regional environmental justice,puts forward constructive suggestions,and provides useful judicial reference for regional environmental governance.
