格式保险免责条款效力评价之逻辑修正

Logical Modification of the Validity Evaluation of the Format Insurance Exemption Clauses

对格式保险免责条款效力评价所适用的法律规范多见于《保险法》第17条、第19条和《合同法》第39条、第40条以及零散司法解释,因法律规范自身不尽完善和对法律适用逻辑的误解,致使司法裁判标准不一和法律规范混用的乱象时有发生。文章以规范内容和逻辑冲突为中心,审查对格式保险免责条款效力评价的法律适用并建议改善现行立法以修正其适用逻辑。

The legal norms applicable to the evaluation of the effectiveness of format insurance exemp⁃tion clauses are more common in Articles 17,19 of the Insurance Law and Articles 39 and 40 of the Contract Law,as well as scattered judicial interpretations.Imperfect legal norms and misunderstanding of the applicable logic have resulted in different judicial standards and improper application of laws.This paper focuses on con⁃tents of laws and logical conflicts,reviewing the application of laws on the evaluation of the effectiveness of for⁃mat insurance exemption clauses and proposing to improve the current legislation to modify the applicable logic.
