招投标投诉、信访和举报法律关系与处理边界有关问题研究

Research on Legal Relation and Processing Border Between Complain,Petition and Accusation In Bidding and Tendering Activities

针对招投标活动中投诉、信访、举报边界不清、受理处理规则不明等问题,本文从权利保障、法律地位、救济途径和适用范围等方面对比分析了三者之间的法律关系;厘清了招投标投诉与举报之间的区别,明确了举报的受理范围及针对不同情形的处理方式;明确了招投标活动中属于信访事项的范围,分析总结了以信访名义进行投诉与举报的处理原则,并结合实际提出相关建议。

About the problem of unclear boundary and rule around complaint,petition and accusation in bidding and tendering activities,the research analyzes the legal relationship of the three from right protection,legal status,remedies and application;clearifies the distinction between complaint and accusation,clearifies the admissibility and approach;clearifies the scope of petition in bidding and tendering activities,and analyzes the principle of complaint or accusation in the name of petition;finally give relevant recommendations based on practice.
