意大利国别法在中国的传播——基于文献计量学的可视化分析

The Study of Italian National Law in China: A Visual Analysis Based on Bibliometrics

为了推动和促进新时代"一带一路"倡议语境下中、意两国法律交往,非常有必要借助大数据法循证学方法提供的便利,描摹中、意两国法律的交流历史、传播现状中蕴含的内在规律,给日益加深的中、意两国经济与文化交往及其未来发展提供指引。本文运用文献计量分析方法,通过检索中国知网、维普数据库以及万方数据库等在内的主流中文数据库中中国法律学者有关意大利国别法的相关研究文献,借助数据统计方法对适格文献进行排纳筛选和评估分析,对中国汉语法学界接受和传播意大利国别法的历史轨迹、现状成绩、存在问题及未来方向等进行了可视化呈现。研究发现:1954年出现了最早的汉语法学界意大利国别法文献研究,相关研究在中国具有平稳但不均衡的发展特征;意大利国别法在中国的传播主要集中在法学类和综合类的专业强校;中国法学界对意大利国别法的接受主题和传播焦点有着鲜明的时代特征和务实色彩;未来,意大利国别法在中国的传播需要中、意两国法学人聚焦双边合作需求尤其是"一带一路"倡议来共同努力。

In order to promote and facilitate the legal exchanges between China and Italy in the context of the Belt and Road Initiative, it is necessary to leverage the evidence-based big-data law approach to trace the history of legal exchanges between China and Italy, to understand the logic behind the current situation, and to provide guidance for deepening economic social and cultural exchanges between China and Italy in the future. This paper employs bibliometrics to search the literature on Italian national law done by Chinese legal scholars in mainstream Chinese databases such as China Knowledge Network, Weipu Database and Wanfang Database. By screening and evaluating appropriate literature, the authors present the historic development, current achievements, existing problems and future directions of the study on Italian national law on the Chinese mainland with visual presentation. The study finds that the first study of Italian national law, which appeared in 1954, has a smooth but uneven development in China.The studies have been mainly carried out in key law schools and comprehensive universities;the subject of Italian national law under study has a distinctive and pragmatic character;the future promotion of the study requires the joint efforts of legal scholars from both China and Italy by focusing on the needs of bilateral cooperation especially the Belt and Road Initiative.
