新冠疫情背景下哄抬价格的法律规制与反思

作为一起全国性突发公共卫生事件,2020年春节期间爆发的新冠疫情引发了社会公众的广泛恐慌,全国各地都发生了不同程度的抢购生活物资和防疫物品的现象,各种价格违法行为尤其是哄抬价格行为也层出不穷。在我国现行法律规范体系中,《价格法》《刑法》以及《突发事件应对法》等法律法规都从不同角度对疫情期间的哄抬价格行为进行了法律规定。而由于疫情这一特殊因素的介入,疫情背景下哄抬价格行为具有不同于一般市场条件下的特殊表现,在对其规制的过程中,如何使法律规制的运作符合法治要求和市场经济规律,需要更加全面的考量。
