行政规范性文件后评估制度对提高行政规范性文件的质量,提升行政执法水平,保障公民合法权益,全面推进依法治国具有重要意义。现有的后评估制度受各地政府工作重点影响较大,呈现出“差异化”“运动化”“重制定轻评估”的倾向,评估主体单一,评价标准各异,评估程序行政主导色彩强烈,透明度和公众参与度较低。有必要建立常态化、规范化、制度化的行政规范性文件后评估制度;结合行政规范性文件有效期、清理制度合理确定评估范围,对可直接清理的文件无须评估,定期与不定期评估相结合;内部与外部评估相结合;推动行政规范性文件信息平台的建设,提升后评估的透明度和公众参与度;确立合理的评估标准,重点评估文件的实效性、协调性和完善性。

The post-evaluation system of administrative regulatory documents is of great significance to improve the quality of regulatory documents,to enhance the administrative law enforcement,to protect the legitimate rights and interests of citizens,and to comprehensively promote the rule of law.Current post-evaluation system is greatly influenced by the work focus of local governments,characterized by singleness of evaluation subject,difference of evaluation standards,strong domination by administrative agencies,and low transparency and public participation,showing the tendency of“being different”,“being dynamic”,and“more emphasis on formulation and less on evaluation”.In order to improve the present post-evaluation system,it is necessary to establish a normalized,standardized and institutionalized post-evaluation system of regulatory documents,to reasonably determine the evaluation scope based on the validity period and cleaning system of regulatory documents(with no evaluation on the documents which can be directly cleared)and to combine regular and irregular evaluation,internal and external evaluation.Meanwhile,it is also essential to promote the construction of information platform for the improvement of the transparency and public participation of the post-evaluation,to establish reasonable evaluation standards and to lay emphasis on the effectiveness,coordination and perfection of the evaluated documents.
