双边投资协定的异质性测度与量化评估——以中国为例 被引量:2

The Measurement and Quantitative Evaluation of the Heterogeneity of Bilateral Investment Treaties:Based on Samples from China

摘要 以中国对外直接投资的50个主要东道国为样本,从"制度环境""整体BIT"和"BIT具体条款"等3个方面评估中国BIT的强度水平。中国与发达国家之间的BIT强度水平高于中国主要投资东道国的BIT总体平均水平,与发展中国家间的BIT强度水平低于主要投资东道国的总体平均水平。此外,在不同地区内,对于不同的BIT条款内容,主要投资东道国与中国之间的BIT情况较为复杂,BIT强度水平差异较大。 Taking 50 major host countries of China's OFDI as samples,the paper quantitatively evaluates the intensity level of these BITs between China and these major investment host countries from three aspects of institutional environment,overall BIT and specific provisions of BIT.The intensity level of BITs between China and developed countries is higher than the overall average intensity level of BITs between China and major investment host countries,while the intensity level of BITs between China and developing countries is lower than that overall average level.In addition,for different BIT provisions in different regions,the situation of BITs between major investment host countries and China is relatively complicated,and the intensity level of BITs varies greatly from country to country.
