人工智能的人机智慧互动方式颠覆了传统的人际关系,对公平、正义、人性尊严等基本人权价值命题提出了严峻挑战。在此背景之下,法伦理学视阈下的道德规范因其预设、先行价值可成为调整人工智能所建构的新型人际关系的重要抓手,而人权理论作为法伦理学的重要思想基础,其固有价值可规制人工智能的开发与运用。故而在人工智能迅猛发展的时代背景下,应不断完善人权伦理秩序,以突破人工智能伦理道德困境,建构中国智慧法治的理想图景。

The human-machine intelligent interaction method of artificial intelligence subverts the traditional interpersonal relationship,and poses serious challenges to basic human rights value propositions such as fairness,justice and human dignity.Under this background,due to its presupposition and prior value,moral norms under the threshold of legal ethics can become an important starting point for adjusting the new interpersonal relationships constructed by artificial intelligence.As an important ideological basis for legal ethics,human rights theory can regulate the development and application of artificial intelligence.Therefore,in the context of the rapid development of artificial intelligence,we should constantly improve the ethical order of human rights in order to break through the ethical dilemma of artificial intelligence and build an ideal picture of China′s wisdom and rule of law.
