从舆论热点案件看刑法解释的价值决断

The Value Determination in Criminal Law interpretation from the Perspective of Highly Discussed Cases

舆论热点案件所关涉到的"可罚性"判断与"需罚性"裁量分歧,并非刑法解释的规范逻辑问题,而是解释中的价值决断问题。"终局性裁判"所做的裁判调适,并不意味着解释决断的价值立场完全转向,而是充分激活了刑法解释的价值决断,在解释决断的主体性、利益量化与情境化原则的综合校正下,以解释之名将个案的情理价值融入刑法规范的逻辑建构之中,进而对裁判规范进行价值化再造。要妥善解决舆论热点案件,不仅需在刑法教义层面权衡解释决断对刑法规范的安定性、合目的性、正义性的调适,厘清特定规范背后的法理、情理与事理,更需在司法实效层面兼顾裁判结论在法律效果、社会效果与政治效果方面的融合情况。

The divergence between the judgment of"punishability"and the discretion of"penalty"involved in highly discussed cases is not a problem of normative logic in criminal law interpretation,but a problem of value determination in interpretation.The adjustment made by the"final judgment"is not a complete change of value position of the interpretation of judgment,but a full activation of the interpretation value of criminal law.Under the comprehensive correction of subjectivity,interest quantification and contextualization principles of interpretation decisions,judicators integrate the decision of individual case’s reasonable value into the logical construction of criminal law norms,and reconstruct the judgment norms in terms of value.To properly resolve highly discussed cases in public,it is necessary not only to weigh the stability,purpose,and justice adjustments of the interpretation and decision to the criminal law norms at the level of criminal law doctrine,but also to clarify the legal principles,reasoning and affair behind specific norms.More importantly,it is necessary to take into account the fusion of judicial conclusions with legal,social and political effects.
