摘要
居住权制度首次写入《中华人民共和国民法典》,成为该法典的一大亮点,具有十分重要的现实意义。但该法典对居住权的规定过于简略,还需进一步完善:强化居住权的财产属性;区分居住权的类型,分别规定居住权的流转方式;细化居住权消灭制度;允许在住宅的一部分上设立居住权;减少对居住权流转的限制,拓展其适用范围,促进房屋充分发挥其使用价值和财产价值。
The Civil Code of China provides for the residency right for the first time in law,which is a bright spot in the Civil Code of China and of great practical significance.However,the provisions of the Civil Code on the residency right are too brief,it is necessary to further improve the system.Based on the analysis of the system of residency right,this paper puts forward the corresponding perfect suggestion:the property attribute of residency right should be strengthened;the types of the residency right should be distinguished,and the circulation modes of residency right should be stipulated separately;the elimination system of residency right should be improved;and the residency right should be allowed to be established on a certain part of a residence;the restriction on circulation of the residency right should reduced,and the scope of application should be expanded to promote buildings to give full play to their use value and property value.
