未成年人被利用实施黑恶势力犯罪虽然总体数量不大,但是有逐年增长的趋势,应当引起高度重视。打击与预防利用未成年人实施黑恶势力犯罪存在由未成年人自身环境、未成年人所处环境、黑恶势力利诱和威逼等三个方面原因所引起的困境。在利用未成年人实施黑恶势力犯罪的案件中,未成年人既是加害人,也是被害人;犯罪结果产生双重危害,即犯罪行为本身所带来的危害后果和对未成年人健康成长权利的侵害,其社会危害性极其恶劣。要坚持预防未成年人犯罪与打击未成年人犯罪并重,保护救助未成年被害人与打击未成年人犯罪并重,微观环境与宏观环境建设并重。

The overall number of using juvenile to commit crimes of evil forces is not large,but there is an increasing trend year by year,which should be highly emphasized.As for the dilemma of using juvenile to commit crimes of evil forces,there are reasons:juvenile themselves,the environment in which they live,and even the inducement and coercion of evil forces.In such cases,juvenile is both the offender and the victim;the result of the crime has double harm,that is,the harmful consequences of the crime itself and the infringement of the rights of the healthy growth of juvenile,which is extremely harmful to the society.Equal attention should be paid to prevent and combat juvenile delinquency,protect and rescue juvenile victims and combat juvenile delinquency,as well as build a micro-and macro-environment.
