论网络爬虫行为的刑法应对

Countermeasures on Criminal Behavior of Web Crawlers

伴随着网络爬虫技术在各领域大规模运用,新的法律风险由此诞生。通过现有案例的分析,发现规制网络爬虫行为尚存在法律体系不完善、基本立场不明确、行为界定不精准等困境。在刑事领域规制网络爬虫行为,应当深明构建网络社会公序良俗与创制法律规则同样重要,树立协同共治理念,坚持刑法谦抑性与比例原则,提倡数据安全法益。对网络爬虫技术原理及其运用进行分解,可以分为数据抓取行为、数据储存行为、信息提取行为、信息使用行为与信息删除行为,借助此分类以探讨各行为的法律性质其刑法适用。

The wide application of web crawler technology in various fields is accompanied by a large number of legal risks.By analyzing existing cases,this paper finds that there are still difficulties in regulating the behaviors of web crawler,such as imperfect legal system,unclear standpoint and inaccurate behavior definition.To regulate in the criminal field,it should be clearly understood that the network construction of public order and good customs is as important as the creation of legal rules.The concept of collaborative and co-governance by adhering to the necessity and proportionality principles of criminal law should also established to promote legal interest of data security.Based on the principles and applications of web crawler technology,it can be divided into data capture and storage behaviors,information extraction,usage and deletion behaviors.With the help of this classification,this paper analyzes the legal nature and the criminal application of these behaviors.
