双系婚姻:对于苏南“并家”习俗的 功能主义解释--以在安置房社区的调研为例

Double Marriage:A Functionalist Interpretation of“BING JIA”Custom in Southern JiangSu——A Case Study of Resettlement Housing Communities

通过对苏南“并家”习俗的功能主义分析发现,双系婚姻模式构成了理解中国婚姻制度变革的重要一维,“并家”的独特之处在于双系并重。从其存在基础与表现形态上看,双系婚姻中明晰的财物关系破坏家庭情感的养成,纵向的情感传承切割横向的亲情,夫妻主体地位受到双系权力的拉扯,“家庭发展目标”取向明显,现代法规切割家庭生成秩序。双系婚姻有义务控制型和资源优化型两种实现方式,双系婚姻的实现区分为纵向传承之“分”和主体建构之“合”,“分”与“合”的辩证存在是双系婚姻实践的合法性基础。

Through the functionalist analysis of the“BING JIA”custom in Southern JiangSu,it’s found that the double marriage model constitutes an important dimension in understanding the reform of China’s marriage system.The unique feature of“BING JIA”is that both of them attach equal importance to each other.Through the analysis of its existence basis and expression form,it is believed that the clear financial relationship in the double marriage destroys the formation of family emotion,the vertical emotional inheritance cuts the horizontal affection,the husband and wife subject status is pulled by the dual power,the orientation of“family development goal”is obvious,and modern laws cut the order of family formation.There are two ways to realize double marriage:obligation control and resource optimization.The realization of double marriage is divided into vertical inheritance and subject construction and the dialectical existence of division and union is the legal basis of the practice of double marriage.
