共享经济视域下网约车平台用工劳动关系从属性认定标准研究--以“权重位序法”为核心进路 被引量:26

摘要 作为共享经济中闲散物力与人力整合运用的典型范式,网约车模式用工的劳动权益保障已成为社会热点。较以创设非标准用工关系,针对传统劳动关系认定方式进行变革更符合法教义学的规范诉求,劳动关系从属性标准的调整当为重中之重。对此应改要件式认定方法为要素式认定范式,具体采用"权重位序法"的认定进路。对于网约车平台用工劳动关系的从属性,应以组织从属性为主、经济从属性为辅予以认定,并衡量其下属各要素的权重与位序。"权重位序法"在价值判断与事实认定层面皆有运用,其运作机制对共享经济视域下劳动关系从属性的认定具有普遍的指导价值。 As a typical paradigm of the integration of idle materials and human resources in the sharing economy,the labor rights and interests protection of online ride-hailing has become a social hotspot.Compared with the creation of non-standard labor relations,the reform of traditional labor relations identification is more in line with the normative appeal of legal doctrine,and the adjustment of labor relations from attribute standards should be the top priority.Therefore,it is necessary to change the identification method of elements into the identification paradigm of elements,and adopt the identification approach of"weight order method".The subordinate attributes of labor relations of online ride-hailing platforms should be mainly determined by the subordinate attributes of the organization and the subordinate attributes of the economy,and the weight and order of the subordinate elements should be measured.The"weight order method"has been applied in both value judgment and fact determination,and its operation mechanism has universal guiding value for the identification of labor relation subordination from the perspective of shared economy.
