唐代对于官私畜产的法律规制刍议

On the Regulation of Official and Private Livestock Production in the Tang Dynasty

唐代畜牧业经济发展较为兴盛,法律的健全是造就这种繁荣的重要原因。对于官私畜产,唐代法律形成以《厩库律》为主干,辅之以《厩牧令》《太仆令》《驾部式》《太仆式》等专项法令、程式以及君主的别敕,又以《贼盗律》和《杂律》完善关于畜产侵害的规制与保护,从制度设计上形成了较为细致完整、系统规范的法律体系。结合唐代政治、经济和宗教文化背景,可窥见畜产在唐代社会重要的经济价值与法律地位。

In the Tang dynasty,the economic development of the animal husbandry industry was relatively prosperous.The sound law of the Tang Dynasty is a significant reason for this prosperity.In the laws of Tang dynasty,the Treasury Law was the mainstay,supplemented by the special orders,regulations and commands,such as Treasury Order,Authority of Horse Order,Driving Regulation,Authority of Horse Regulation and so forth.Stealing Law and Miscellaneous Law improved the protection on infringement of livestock products.Comprehensively from the design of the system,these laws formed a relatively complete and systematic legal system in order to show significant value and special status of livestock products on the political,economic and cultural background.
