论内幕交易、泄露内幕信息罪定罪量刑标准的调适与完善

The Adjustment and Perfection of the Standards of Convicting and Sentencing Insider Trading and Divulging Inside Information Crimes

内幕交易、泄露内幕信息罪和利用未公开信息交易罪被一并放在刑法第一百八十条分两款予以规定,说明两罪的违法和责任程度相当。“马乐案”的判决,更是明确了利用未公开信息交易罪的法定刑是对内幕交易、泄露内幕信息罪的法定刑的全部援引。2019年最高人民法院、最高人民检察院发布了《关于办理利用未公开信息交易刑事案件适用法律若干问题的解释》,大大提高了利用未公开信息交易罪的定罪量刑标准,与内幕交易、泄露内幕信息罪的现行定罪量刑标准形成了巨大差异,造成了法律适用的不统一,有碍司法的公平公正。本文将从该两罪的定罪量刑由来、差异和原因三个方面展开论述,对内幕交易、泄露内幕信息罪定罪量刑标准进行调适并提出完善建议。

The crimes of inside trading,disclosing inside information and trading with undisclosed information are stipulated in two sections of Article 180 of the criminal law,which shows that the two crimes have the same degree of illegality and responsibility.The judgment of“Ma Le’s case”makes it clear that the legal punishment of the crime of trading with unpublished information has become a criterion for legally punishing inside trading and disclosing inside information crimes.In 2019,the Supreme People's Court and the Supreme People's Procuratorate issued the Interpretation of Several Issues Concerning the Application of Law in Handling Criminal Cases of Trading with Undisclosed Information,which greatly improved the standard of convicting and sentencing the crime of trading with unpublished information,but shows a huge difference with the current standard of convicting and sentencing inside trading and disclosing inside information crimes.It results in the inconsistency of the application of law and hinders the judicial fairness and justice.This paper discusses the origin,differences and reasons of convicting and sentencing the two crimes,revises the standard of convicting and sentencing them,and makes suggestions for improvement.
