体系化与科学化:环境法法典化目的的二元塑造

Systematization and Scientization:Dual Shaping of the Purpose of Environmental Law Codification

环境法法典化的目的反映了环境法典编纂的预期结果,决定了环境法法典化的理论方案。现有环境法实质法典化论和形式法典化论,均秉持以环境法律规范体系化为内容的法典化一元目的论。然而,环境法治实践具有法治实践和科技实践的二维面向,一元目的论仅关注到法治实践面向,忽略了科技实践面向,这极大地制约了现有理论对环境法法典化实践的解释力和指导力,亟须立足于环境法治的科技实践面向,证成环境法律规范科学化是环境法法典化目的的重要组成部分,进而塑造由体系化和科学化构成的环境法法典化二元目的论。二元目的论不仅能证明环境法实质法典化论是兼顾体系化和科学化目的的最优方案,而且能通过阐释环境法法典化的目标、基本思路、具体方案与实现步骤,更加清晰地描绘环境法法典化的理论方案。

The purpose of the environmental law codification reflects the expected results of the codification of the environmental law and determines the theoretical scheme for the environmental law codification.The existing substantive codification theory and formal codification theory of environmental law both adhere to the monistic teleology,which only pays attention to the systematization of environmental legal norms.However,the practice of environmental law has two dimensions of law and technology.The unitary teleology only pays attention to the practice of the rule of law and ignores the practice of science and technology,which greatly restricts the explanatory and guiding power of the existing theories to the codification of environmental law.It is necessary to argue that the scientization of environmental law is an organic component of the purpose of environmental law codification based on the needs of the scientific and technological practice of environmental law,and then to shape the dual teleology of environmental law codification that is formed by systematization and scientization.The dual teleology not only verifies that the substantive codification of environmental law is the best solution for both systematic and scientific purposes,but also can explain the goals,basic ideas,specific plans and implementation steps of environmental law codification,so as to describes the theoretical scheme of environmental law codification more clearly.
