摘要
个人健康信息编码行为是行政相对人为依法履行疫情防控义务,请求放松应急处置措施管制,通过电子政务信息系统,向疫情防控机关申请确认其涉疫情健康风险状态的行政确认行为。行政相对人依法申请个人健康信息码既是一项义务,也是一项权利。个人健康信息编码行为是一种独立的行政确认行为,不附属于后续行为。根据应用场景的不同,个人健康信息编码行为对行政相对人和行政机关的后续行为产生不同的法律效果。
Personal health information coding behavior is the administrative confirmation behavior that the administrative counterparts request to relax the control of emergency response measures in order to fulfill the obligation of epidemic prevention and control according to law,and applies to the epidemic prevention and control organ to confirm its health risk status related to epidemic situation through e-government information system.It is not only an obligation but also a right for administrative counterpart to apply for personal health information code according to law.Personal health information coding behavior is an independent administrative confirmation behavior,which is not attached to the follow-up behavior.According to the different application scenarios,personal health information coding behavior has different legal effects on the follow-up behavior of administrative counterparts and administrative organs.
