摘要
印度已搭建相对系统的关于反倾销日落复审的组织架构和法律框架。调查当局亦能较好地依法依规开展反倾销日落复审。但是,由于现行相关条款多为原则性条款,有关细节不明确,因此,调查当局拥有较大自由裁量权,随意性较强,使得利益相关方,特别是被申诉方无所适从,日落复审之结论亦难言公平。对此,一方面,我国企业在关注相关法律法规和政策的同时,在面对日落复审时,应积极参与,可寻求专业团队和人士的支持,尽力维护自身合法权益;另一方面,应进一步探寻符合自身实际的多元化发展道路,分散风险。
India has established a relatively systematic organizational structure and legal frameworks for anti-dumping sunset reviews.The authority indeed carries out anti-dumping sunset review in accordance with relevant laws and regulations.However,the existing rules are mainly principles,leaving details to be clarified.Hence,the authority has great discretion and it does fully exercise it,which may lead to arbitrarily practice and the fact that the interested parties,especially the respondent,may then feel confused about the situation.Fairness of its conclusions with regard to the sunset review remains uncertain.Accordingly,from the standpoint of Chinese companies,on the one hand,while keeping eyes closely on the latest relevant laws,regulations and policies,they should participate actively in a sunset review,additionally seeking help from the professionals,to strive for legal rights,and on the other hand,they should continue to seek out a proper and diversified way of development for better risk control.
