Research on the Professional Development of People’s Mediation System

人民调解制度在纠纷解决体系中日渐边缘化,为适应新的纠纷调解需求,人民调解制度专业化转型是必然趋势。专业化发展显现的问题主要表现在片面强调法律化、过度依赖国家权力的支持、缺乏分流诉讼的规范化程序机制等方面。必须寻求人民调解自身独特的制度优势与专业化发展之间的平衡点,激发人民调解制度自身的发展内力,建立规范化的程序机制合理分流诉讼,以实现人民调解制度的复兴。

The people’s mediation system is increasingly marginalized in the dispute resolution system.In order to meet the needs of the new dispute mediation,the professionalization of the people's mediation system is an inevitable trend.The problems in the development of specialization are mainly manifested in one-sided emphasis on legalization,excessive reliance on the support of state power,and lack of standardized procedural mechanism of shunt litigation.We must seek the balance between the unique system advantages of the people’s mediation and its professional development,stimulate the internal force of the development of the people’s mediation system itself,establish a standardized procedural mechanism,and reasonably distribute litigation,so as to realize the revival of the people’s mediation system.
