中医药专门保护制度的框架构想——从国际经验的历史沿革角度分析

The Framework Conception of Special Protection System of Traditional Chinese Medicine:Analysis from the Perspective of Historical Evolution of International Experience

国际社会对于传统知识以及传统医药知识的保护已有例可循,一些发展中国家也积累了宝贵的经验,通过梳理当前各国际组织、国际公约的重要原则及其在传统医药保护方面已有的显著成效,并借鉴部分发展中国家的先进经验,分析国际社会保护传统医药知识的核心原则,归纳出保护中医药传统知识的理论模型。以此为基,尝试设计我国中医药专门保护制度的框架和原则。

The international community has established examples to follow for the protection of traditional knowledge and traditional medical knowledge,and some developing countries have also accumulated valuable experience.This study teased out the important principles of current international organizations and international conventions and their remarkable achievements in the protection of traditional medicine,and drew on the advanced experience of some developing countries,analyzed the core principles of traditional medicine knowledge protected by the international society,and summarized the theoretical model of the protection of traditional Chinese medicine knowledge.Based on this,the framework and principles of traditional Chinese medicine special protection system in China were designed.
