我国地方居家养老服务条例评析与完善——基于22件法律文本的分析

Assessment of Local Regulations on Home-based Care Services in China and Ways to Improve:Based on an Analysis of 22 Legal Texts

当前我国诸多地方都出台了居家养老服务条例,梳理和对比分析了22件地方居家养老服务条例的基本框架、参与主体、服务内容、服务保障和监督管理措施等核心内容,发现这些地方立法中存在保障主体范围较窄、社会组织参与能力不足、居家老年人满意度较低等一系列问题。要解决这些问题,较为可行的手段是扩大老年人覆盖范围、出台培育社会组织能力的政策和建立居家老年人高效反馈机制等。

Regulations on home-based care services have been promulgated in many regions in China.This paper combed and analyzed the basic framework,main participants,service items,service guarantee and measures of supervision and management of regulations in 22 provinces and cities,and found a series of problems including limited coverage,insufficient participation of social organizations,and low satisfaction of the elderly at home.This paper then proposed that to resolve these problems,we need to expand the coverage,issue policies that can improve abilities of social organizations and establish an efficient feedback mechanism for the elderly at home.
